MAYBELLINE “ILLEGAL LENGTH” MASCARA: DOES IT ADD 4 MILLIMETERS TO YOUR LASHES?

MAYBELLINE NEW YORK’S “ILLEGAL LENGTH” FIBER EXTENSIONS MASCARA
Doesn’t Maybelline New York’s advertising and labeling give you the impression that it’s “Illegal Length” Fiber Extensions Mascara will add 4 millimeters of extra visible length to your eye lashes?
The “Illegal Length” mascara television commercials boast that Maybelline’s “unique Fiber-Fix brush and formula seal [their] longest fibers onto lashes for 4mm of extra visible length.” Similarly, the mascara’s packaging claims that the product’s “Fiber-Fix Brush and Sealing Formula work together to optimize with 4mm fiber extensions for dramatically longer lashes.” Maybelline’s print and online advertising even prompts unwitting consumers to “[b]reak every law of lengthening with 4mm of measureable extensions.” According to the product’s packaging, the mascara will create “[i]nstant lash extensions” with “[o]nly a few strokes” of the product.
Eppsteiner Law, APC have received complaints that, contrary to Maybelline New York’s representations, its “Illegal Length” Mascara does not lengthen lashes the full 4 millimeters as promised. Users have complained to Eppsteiner Law, APC that Illegal Length mascara either barely lengthens lashes, or does not lengthen them at all.
Cosmetics are loosely regulated by the U.S. Food and Drug Administration (“FDA”), and the law prohibits cosmetic misbranding. According to Section 602 of the FD&C Act [21 U.S.C. 362], a cosmetic is misbranded if labeling is false or misleading in any manner.
You should not confuse Maybelline New York’s “Illegal Length” Mascara with Maybelline’s “Illegal Lengths” mascara (ending with an “s”), which was discontinued.
