Electrolux Home Products’ Frigidaire refrigerators have ice makers that do not, within the time advertised, make the amount of ice Electrolux represented they would make. They do not make ice, nor do they keep ice frozen. This performance has been reported in online forums and from Electrolux and Frigidaire owners.
Eppsteiner & Fiorica have filed a lawsuit on behalf of a California resident that purchased a new Frigidaire French Door Refrigerator/Pull-out Freezer fridge.
The Frigidaire ice maker was represented to make up to ten pounds of ice every twenty-four hours. It didn’t. Not only did it not make the amount of ice Frigidaire represented it would, it broke-down repeatedly, stopped making ice or made ice that the fridge could not keep frozen. A refrigerator with an ice maker must make and maintain ice to fulfill its basic purpose. The subject refrigerators don’t. The lawsuit is a putative class action, and if the Court certifies the case as a class action, the case will proceed for the benefit of all California Frigidaire defective ice maker owners.
The lawsuit alleges that Electrolux has a history of making repairs it knows will not fix the ice maker malfunction. The lawsuit alleges Electrolux does this to try and mollify angry consumers; e.g. doing something to the fridge is a demonstration that Electrolux is trying to fix them so people will not be angry at a company that is trying to fix its defective product. However, given that Electrolux, to the knowledge of Eppsteiner & Fiorica, does not have a repair for the described malfunction, repair attempts are futile and only raise false hopes and waste consumers’ time.
The subject Electrolux and Frigidaire branded fridges were expensive. Despite the great expense and represented performance, Electrolux has not yet implemented a recall of its fridges that have defective ice makers.
At a cost of between $2300 and $4000 per fridge, a recall would be a very expensive proposition. To date, Electrolux has not done “the right thing” and just refunded the price of the refrigerators so that owners can buy non-defective refrigerators that have ice makers.
Electrolux thought it had a break-through in ice making technology. The subject fridges use a unique system to make ice while putting the ice maker in the fresh food/refrigerator compartment. Most ice makers are located within the freezer section of a refrigerator, making ice creation and preservation easier because the environment is below 32 degrees. From the reports of Electrolux and Frigidaire branded fridges, the new technology does not work.
Eppsteiner & Fiorica wants to receive information from all of the Electrolux and Frigidaire owners whose fridges’ have either not made ice, as much ice as represented or don’t keep ice frozen.
